3. The Court finds that the worker was guilty of gross misconduct
but considers that, having regard to all the circumstances,
dismissal is too severe a penalty. The Court therefore recommends
that, provided the worker and the Union accept now that there was
a case of gross misconduct, the worker should be re-instated
without compensation for loss of earnings on 16th November, 1987.

2. On 9th November, 1987, the Court investigated the above
dispute. The following is the Court's recommendation.

RECOMMENDATION:

3. The Court finds that the worker was guilty of gross misconduct
but considers that, having regard to all the circumstances,
dismissal is too severe a penalty. The Court therefore recommends
that, provided the worker and the Union accept now that there was
a case of gross misconduct, the worker should be re-instated
without compensation for loss of earnings on 16th November, 1987.
