Recommendation:
3. The Court, following receipt of additional information at the
hearing on the 17th December, 1987, has given further
consideration to the claim which was the subject of Labour Court
Recommendation No. 11368.

In the light of the additional information received the Court is
satisfied that overtime worked in the front hall should
legitimately be included as part of the overtime worked in the
Cobalt area. The Union's submission that this overtime was
introduced to minimise the impact on earnings due to the
introduction of a linear acceleration machine is not contested by
Management. The Court accordingly recommends that the terms of
Labour Court Recommendation No. 11368 be extended to include
overtime worked in the front hall.

In the Court's view compensation should be calculated on current
rates rather than on those applying in 1985.

The Union, on the 17th December claimed that Labour Court
Recommendation No. 11368 should be applied to all porters who
suffered loss of earnings. (The original claim dealt with in
LCR11368 referred to 5 porters). The Court recommends concession
of this claim as being reasonable in the circumstances.

The Court further recommends that Hospital Management consider
delaying implementation of two further cost cutting proposals for
a period after a return to work.

2. Following a Labour Court investigation into this dispute on
the 17th December, 1987, the Court recommends as follows:-
