The claimant contends that she is entitled to the same same rate of remuneration as that paid by the respondent to the named male comparator in terms of Section 3(b) and 3(c) of the Anti-Discrimination (Pay) Act, 1974. The respondent rejects the claim and argues that the claimant does not perform 'like work' with the named male comparator in accordance with the provisions of the Act and it also stated that there were grounds other than sex for the difference in the pay of the claimant and the named male comparator.
