Donegal County Council

File No. EE 2001/198

Date of Issue 18/11/2002

Employment Equality Act, 1998 Sections 6 and 8 - Employment - Promotion - Gender

The complainant alleges that she was discriminated against by the respondent on the gender ground when she was persuaded to withdraw her application for the position of Acting Senior Staff Officer (Grade VI) in the Housing Department. She also alleges that the changes which were effected in relation to the reorganisation of the work of the Housing Department also discriminated against her on the grounds of gender. After this work reorganisation the position was re-advertised and the complainant again applied. She was placed second on a panel following her interview and the successful applicant was male. It is the complainant's contention that her failure to be appointed to the position resulted in discrimination on the gender ground as she was better qualified and had more overall experience than the successful male candidate.
